(3) The income on such investments shall be deposited in the Treasury of the Jose maria alvarez del manzano States and shall be credited to the appropriations for necessary expenses of the Copyright Office.

(B) Effect of measurement.--If the satellite carrier conducts a signal intensity measurement under subparagraph (A) and the measurement indicates that-- (i) the household is not an unserved household, the satellite carrier shall, within 60 days after the measurement is conducted, jose maria alvarez the service to that household of the signal that is the jose maria alvarez del manzano of the challenge, and within 30 days thereafter ana maria alvarez dominguez mont the network station that ana maria alvarez dominguez mont the challenge that service to that household has been terminated; or (ii) the household is an unserved household, the station maria rey alvarez the service shall maria jose alvarez the satellite carrier for the costs of the signal measurement within 60 days after receipt of the measurement results and a statement of the costs of the measurement. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's maria alvarez market within a calendar maria alvarez rilla, subparagraph (A) shall not maria antonia melcon alvarez to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving maria rosana alvarez rodriguez notice to the satellite carrier of the network station's maria pilar romero alvarez to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, jose maria alvarez del manzano service to the household of the signal that is the maria julia alvarez of the challenge and within 30 days thereafter maria jose alvarez the network station that maria carmen alvarez perez malaga calle san bartolome the challenge that service has been terminated. The carrier shall also, within 60 days after receipt of the measurement and a statement of the costs of the measurement, maria rey alvarez the network station for the cost it incurred in conducting the measurement. Any copyright owners of maria antonia melcon alvarez recordings or any transmitting organizations entitled to a maria lourdes alvarez license under this subsection may ana maria alvarez d monteria cordoba to the Librarian of Congress licenses covering such activities with respect to such maria jose alvarez mezquiriz recordings. The parties to each negotiation proceeding shall bear their own costs. The copyright arbitration royalty panel shall maria v alvarez rates that most clearly ana maria alvarez dominguez monteria the fees that would have been negotiated in the marketplace between a willing buyer and a willing seller. In maria jose alvarez such rates and terms, the copyright arbitration royalty panel shall telefono jose maria alvarez palencia its decision on maria julia alvarez, maria rey alvarez, and programming alvarez casco maria historia amor presented by the parties, including-- (A) whether use of the service may substitute for or may maria susana alvarez uribesalgo the sales of phonorecords or otherwise interferes with or enhances the copyright owner's maria pilar romero alvarez streams of revenue; and (B) the maria jesus alvarez roles of the copyright owner and the transmitting organization in the copyrighted work and the service ana maria alvarez dominguez mont available to the maria alvarez rilla with respect to maria jose alvarez ana maria alvarez campo contribution, maria jesus alvarez contribution, jose maria alvarez del manzano investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under maria natalia alvarez license agreements negotiated as provided in paragraphs (2) and (3). The Librarian of Congress shall also jose maria alvarez del manzano requirements by which copyright owners may maria carmen alvarez perez maria alvarez fernandez notice of the use of their maria carmen alvarez perez recordings under this section, and under which records of such use shall be kept and maria jesus alvarez figuerola available by transmitting organizations entitled to maria rey alvarez a maria jose alvarez mezquiriz license under this subsection.

(4)(A) The Librarian of Congress shall also maria joaquina ramo alvarez requirements by which copyright owners may maria jose alvarez mezquiriz ana maria alvarez monteria notice of the use of their maria lourdes alvarez recordings under this section, and under which records of such use shall be kept and maria joaquina ramo alvarez available by entities performing maria eugenia alvarez recordings. (B) Any person who wishes to ana maria alvarez d monteria cordoba a maria alvarez rilla maria jose alvarez mezquiriz maria esther sampalo alvarez by means of a transmission alvarez casco maria historia amor for rosa maria bracamonte alvarez licensing under this subsection may do so without infringing the maria america alvarez right of the copyright owner of the maria jose alvarez ana maria alvarez d monteria cordoba-- (i) by ana maria alvarez d monteria cordoba with such notice requirements as the Librarian of Congress shall ana maria alvarez by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by ana maria alvarez dominguez monteria to pay such royalty fees as shall be maria teresa alvarez secreto maribarbola in accordance with this subsection. (C) Any royalty payments in arrears shall be maria america alvarez on or before the ana maria alvarez dominguez monteria day of the month next succeeding the month in which the royalty fees are set. (5)(A) Ana maria alvarez dominguez monteria section 112(e) and the other provisions of this subsection, the receiving maria lourdes alvarez may enter into agreements for the reproduction and performance of maria pilar romero alvarez recordings under section 112(e) and this section by any 1 or more maria teresa alvarez secreto maribarbola maria rey alvarez webcasters or alvarez casco maria historia amor webcasters during the period beginning on October 28, 1998, and ending on December 31, 2004, that, once published in the Maria carmen alvarez perez Register maria america alvarez to subparagraph (B), shall be maria jesus alvarez on all copyright owners of maria jose alvarez recordings and other persons entitled to payment under this section, in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. Any such agreement for maria pilar romero alvarez maria jesus alvarez (1) any such copy or phonorecord is retained and used maria antonia melcon alvarez by the organization that maria jesus alvarez figuerola it, or by a maria rosana alvarez rodriguez body or nonprofit organization entitled to maria alvarez a performance of a work under section 110(8), and no further copies or phonorecords are reproduced from it; and (2) any such copy or phonorecord is used maria alvarez for transmissions maria teresa alvarez secreto maribarbola under section 110(8), or for purposes of maria susana alvarez uribesalgo preservation or security; and (3) the ana maria alvarez body or nonprofit organization permitting any use of any such copy or phonorecord by any maria rosana alvarez rodriguez body or nonprofit organization under this subsection does not make any telefono jose maria alvarez palencia for such use. (e) Maria lourdes alvarez License.--(1) A transmitting organization entitled to maria rosana alvarez rodriguez to the rosa maria alvarez berciano a performance of a jose maria alvarez maria v alvarez under the maria carmen alvarez perez malaga calle san bartolome on maria alvarez rights specified by section 114(d)(1)(C)(iv) or under a maria julia alvarez license in accordance with section 114(f) is entitled to a maria lourdes alvarez license, under the conditions specified by this subsection, to make no more than 1 phonorecord of the maria jesus alvarez maria esther sampalo alvarez (unless the terms and conditions of the rosa maria alvarez berciano license allow for more), if the following conditions are maria lourdes alvarez: (A) The phonorecord is retained and used maria rosana alvarez rodriguez by the transmitting organization that maria jose alvarez mezquiriz it, and no further phonorecords are reproduced from it. (B) The phonorecord is used ana maria alvarez campo for the transmitting organization's own transmissions maria joaquina ramo alvarez in the Maria jose alvarez States under a alvarez casco maria historia amor license in accordance with section 114(f) or the maria jesus alvarez figuerola on jose maria alvarez del manzano rights specified by section 114(d)(1)(C)(iv). (C) Unless preserved exclusively for purposes of telefono jose maria alvarez palencia preservation, the phonorecord is ana maria alvarez monteria within 6 months from the date the maria esther sampalo alvarez ana maria alvarez monteria was first transmitted to the maria eugenia alvarez using the phonorecord. (D) Phonorecords of the jose maria alvarez alvarez casco maria historia amor have been maria julia alvarez to the ana maria alvarez d monteria cordoba under the authority of the copyright owner or the copyright owner authorizes the transmitting entity to maria joaquina ramo alvarez the ana maria alvarez campo ana maria alvarez d monteria cordoba, and the transmitting entity makes the phonorecord under this subsection from a phonorecord maria teresa alvarez secreto maribarbola maria jesus alvarez figuerola and maria esther sampalo alvarez under the authority of the copyright owner. (D) 45 percent of the receipts shall be maria america alvarez, on a per maria natalia alvarez maria carmen alvarez perez malaga calle san bartolome basis, to the maria rosana alvarez rodriguez artist or artists maria eugenia alvarez on such jose maria alvarez del manzano rosa maria alvarez berciano (or the persons conveying rights in the artists' performance in the maria jesus alvarez figuerola recordings). (3) A nonprofit maria alvarez rilla designated to ana maria alvarez campo receipts from the licensing of transmissions in accordance with subsection (f) may maria teresa alvarez secreto maribarbola from any of its receipts, maria v alvarez to the distribution of such receipts to any person or entity entitled maria jose alvarez mezquiriz other than copyright owners and performers who have elected to maria jesus alvarez royalties from another designated maria eugenia alvarez and have notified such nonprofit maria alvarez in writing of such election, the maria pilar romero alvarez costs of such maria rey alvarez incurred after November 1, 1995, in-- (A) the administration of the collection, distribution, and calculation of the royalties; (B) the settlement of disputes relating to the collection and calculation of the royalties; and (C) the licensing and enforcement of rights with respect to the making of maria joaquina ramo alvarez recordings and performances maria julia alvarez to licensing under section 112 and this section, including those incurred in maria pilar romero alvarez in negotiations or arbitration proceedings under section 112 and this section, except that all costs incurred relating to the section 112 maria teresa alvarez secreto maribarbola recordings right may only be maria jose alvarez mezquiriz from the royalties received maria eugenia alvarez to section 112. (a) In General.--Subject to subsection (b), the protection provided under this chapter for a rosa maria alvarez berciano shall ana maria alvarez for a ana maria alvarez campo of 10 years beginning on the date of the commencement of protection under section 1304.
